"This lowers the barrier to entry and also opens up a wholesale market. Then you're offering a much broader variety of products for patients and customers, which is really positive," Savchenko explained.

"We're one of really the only established markets in the country that doesn't have a wholesale market. So I think it would be really, really good for the industry and for patients and for customers to reap the benefits of a wholesale market, because then we'll have other groups coming in and have a better variety of products," Savchenko said.

“The cancellation of the upcoming cannabis rescheduling hearings, attributed to procedural inconsistencies and alleged corruption within the DEA, comes as little surprise and further delays the process,” expressed Paula Savchenko.

“We are working with eight groups to appeal the denial of their licenses,” said Savchenko. “We filed petitions with the Department of Health a couple weeks ago appealing the denial of those licenses, requesting for the Department of Health to refer those petitions over to administrative court.”

"We worked with seven groups to appeal their denial,” Savchenko said.

“We may see a legislative fix, so basically to work with the legislature to pass some sort of initiative that would allow for some of the groups or all of the groups that received a notice of intent to licenser, to be able to move forward and actually be able to receive the award of license, and let the litigation continue on for those who didn’t receive it," Savchenko said.

“Pretty much anybody who received a denial of license letter is . . . going to appeal the license. It’s going to hold up the licensing process significantly, because more likely than not the licenses will not be issued until that litigation process is over, and that litigation process might take six months to a year, probably on the longer side,” said Paula Savchenko.

“We’re still excited. Obviously, the majority of people in the industry would rather have had recreational pass but we all are pretty confident that it’s going to pass sometime in the next two to four years,” Savchenko said.

“I'm always going to recommend that it should be a competitive process,” Savchenko said. “The reason for that is because you really do want the best groups to be operating in this industry. When you go through a lottery, you are not able to really choose who's best for the state and for the patients, in my opinion.”

That’s really important just because, you know, if that side of it isn’t done properly, then you can unfortunately disqualify yourself, even if you have everything else,” Savchenko said.

“The downfall in my opinion of the process was due to the back-and-forth from the AMCC once it was time for the licenses to be issued, and the rushed timeframe for them to review all application materials, presentations, and the like," Savchenko said.

"I think Alabama has been really underrated as a market, and I’m not really sure why," Savchenko said.

"Due to its prior rejections, it is now vital the pro-legalization campaign emphasizes the measure's potential for increasing economic growth and job development, as well as reducing the burden on law enforcement to allow them to more effectively allocate their resources to other crises, such as the fentanyl and opioid epidemics," Savchenko said.

"I think what's happening is that people are just waiting to submit their applications until closer to the deadline," Savchenko noted. "Because it does take some time to get all the pieces together and ready to submit."

“As far as the way that the licensing process is currently going, where the existing operators are able to apply for and get additional licenses, that’s actually very unique,” Savchenko said. “You don’t see that in most states, where the existing license holders are getting priority for additional licenses. You typically just see where the existing license holders have the first opportunity to turn over to recreational as opposed to get more licenses.”

“I think it’s going to be really difficult to use this as concrete evidence,” Savchenko said. “Just because someone smoked this morning and they’re driving at 6 p.m. doesn’t mean that they’re still high.”

“This is actually typical in most states where the cultivators and manufacturers will get the licenses first before the retailers, because the cultivators and manufacturers need to be able to produce the product to supply the retail stores,” Savchenko said.

"Operators must utilize the prior inaccessible benefits to their advantage such as Research and Development (R&D) tax credits . . . For example, cultivators may qualify for the R&D credit by experimenting with new farming methods to increase crop yield."
